Terms of Service

1. About these terms
These Terms of Service ("Terms") govern your access to and use of the Pythia platform and related services (the "Service") operated by Pythia Software Inc. ("Pythia", "we", "us", or "our"). By creating an account, taking an assessment, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
These Terms work together with our Privacy Policy and our Consent Form, which describe how we handle personal information. In the event of a conflict between these Terms and the Privacy Policy on a matter of personal information, the Privacy Policy governs.
2. Definitions
- "Respondent" means an individual who takes a Pythia assessment.
- "Organizational Client" or "Client" means a company or organization that uses the Service to assess candidates or employees.
- "Administrator" means an individual authorized by an Organizational Client to access the Service on its behalf.
- "Assessment" means the simulated interview and personality questionnaire offered through the Service.
- "Profile" means the personality profile generated from a Respondent's Assessment.
- "Beta phase" means the development and testing period during which the Service is offered free of charge, currently running from June 2026 to September 2026.
3. Eligibility
You must be at least 18 years of age to use the Service. The Service is intended for adults and is not directed at minors. By using the Service, you confirm that you meet this requirement and that any information you provide about yourself is accurate.
4. The Service during the beta phase
The Service is currently offered free of charge during the beta phase. The Service is provided for development, testing, and research purposes, and the models that generate Profiles are still being refined. You acknowledge that the Service is experimental, that Profiles may be incomplete or inaccurate, and that the Service may change, be interrupted, or be discontinued at any time.
We may add, modify, or remove features during the beta phase without notice. We do not guarantee any particular level of availability or performance during this period.
5. Accounts
To use certain parts of the Service, you must create an account. You are responsible for keeping your login credentials confidential and for any activity that occurs under your account. You agree to notify us promptly if you believe your account has been accessed without your authorization. You may only create an account for yourself, and you may only complete an Assessment as yourself. You may not impersonate another person or complete an Assessment on someone else's behalf.
6. Acceptable use
You agree not to do any of the following:
- Use the Service for any unlawful purpose, or in a way that infringes the rights of others.
- Attempt to access accounts, data, or systems that you are not authorized to access.
- Attempt to copy, reverse engineer, decompile, or extract the underlying models, software, or training data of the Service.
- Use automated means to scrape, harvest, or interfere with the Service.
- Upload or transmit malicious code, or attempt to disrupt or compromise the security or integrity of the Service.
- Attempt to manipulate or falsify an Assessment, or to interfere with the accuracy of a Profile.
- Use the Service to unlawfully discriminate against any person.
We may suspend or terminate access for any use that breaches these Terms.
7. Obligations of Organizational Clients
If you use the Service as an Organizational Client or Administrator, the following additional terms apply to you.
- You may access only the Assessments and Profiles of your own candidates or employees, within the access scope provided to you. You may not attempt to access the data of any other organization.
- You must use Profiles in compliance with all applicable employment, human rights, and privacy laws.
- You acknowledge that a Profile is generated through automated processing and is not a decision about any individual. You must not use a Profile as the sole basis for a consequential decision about a person, such as a hiring, promotion, or termination decision. You agree to provide a review by a qualified person before any consequential decision is made, and to honour each Respondent's right to request such a review and to submit observations, as described in our Consent Form.
- You are responsible for obtaining any consents and providing any notices required of you as an employer or prospective employer under applicable law, in addition to the consent Pythia obtains directly from Respondents.
8. Automated processing
Pythia uses automated processing to generate Profiles. Pythia does not itself make decisions about Respondents. Respondents have the right to be informed that their Profile is generated through automated processing, to request a review by a qualified person, and to submit observations, as set out in the Consent Form and Privacy Policy.
9. Intellectual property
The Service, including the platform, software, models, and all associated intellectual property, is and remains the property of Pythia. These Terms do not grant you any ownership in the Service. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service for its intended purpose.
You retain your rights in the personal information and content you provide. You grant Pythia the right to process that information in order to provide the Service and, where you have consented, to improve our models, as described in the Privacy Policy and Consent Form.
10. Privacy
Our collection and use of personal information is described in our Privacy Policy and Consent Form. By using the Service, you acknowledge that you have read the Privacy Policy. Your participation in research and your sharing of sensitive information are governed by the Consent Form, and you may withdraw your consent as described there.
11. Disclaimers
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we make no warranties of any kind, whether express or implied, regarding the Service, including any warranty that the Service will be uninterrupted, error free, or secure.
A Profile is a research-based estimate of personality traits. It is not a clinical or psychological diagnosis, not a measure of a person's worth or ability, and not a guarantee of job performance or suitability. Profiles should not be relied upon as the sole basis for any decision about a person.
12. Limitation of liability
To the fullest extent permitted by applicable law, Pythia will not be liable for any indirect, incidental, special, or consequential damages arising out of or relating to your use of the Service. Nothing in these Terms limits any liability that cannot be limited or excluded under applicable law, including liability for bodily or moral injury or for intentional or gross fault under the law of Quebec.
13. Indemnification
If you are an Organizational Client, you agree to indemnify and hold Pythia harmless from any claim, loss, or liability arising out of your use of Profiles, your decisions about individuals, or your breach of these Terms or of applicable employment or privacy law, to the extent permitted by law.
14. Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. On termination, the provisions of these Terms that by their nature should survive, including those on intellectual property, disclaimers, limitation of liability, and governing law, will continue to apply. The handling of your personal information after termination is described in the Privacy Policy.
15. Changes to these terms
We may update these Terms from time to time, for example as the Service evolves or moves from the beta phase to commercial operation. When we make a significant change, we will post the updated Terms on our website and, where appropriate, notify registered users. Your continued use of the Service after a change takes effect means you accept the updated Terms. The date at the top shows when these Terms were last updated.
16. Governing law
These Terms are governed by the laws of the Province of Quebec and the laws of Canada applicable there, without regard to conflict of law rules. Any dispute relating to these Terms or the Service will be brought before the courts of the judicial district of Québec, unless applicable law requires otherwise.
